Formulation of construction investment projects: Pursuant to clause 1 Article 52 of the Law on Construction 2014, amended and supplemented by clause 10 Article 1 of the Law on Amendments to Construction Law 2020, “Upon construction investment, project owners or agencies or organizations assigned to take charge of project preparation shall make construction investment feasibility study reports”.
Applicants for appraisal of feasibility study reports shall submit the apploacation directly or online or via post to the Public Administrative Service Center of the province/city or the Department of Receiving and Returning Results of Administrative Procedures of the Department of Construction or Management Board Industrial parks, export processing zones, high-tech parks, economic zones (Provincial/city specialized construction agency).

Pursuant to Clause 1 Article 11 of the Decree 15/2021/ND-CP dated March 3rd, 2021 of the Government: “The content of pre-feasibility study report shall comply with Article 54 of the Law on Construction 2014, amended in Clause 12, Article 1 of Law on Amendments to Construction Law 2020”.
- Procedures for the appraisal of feasibility study reports
Within 05 working days from the day on which the application is received, the construction authority shall:
a) Request the applicant in writing for supplemental documents.
b) Return the appraisal application in case of rejection and clarify the reason for rejection.
c) Send documents to competent fire prevention and fighting agencies to collect opinions on fire prevention and fighting solutions of the basic design (if requested by the investor).

- What are the time limits for the appraisal of construction investment feasibility study reports?
Pursuant to Clause 2 Article 59 of the Law on Construction 2014, amended by Clause 16 Article 1 of the Law on Amendments to Construction Law 2020, a period for appraisal by a specialized construction agency of not exceeding:
a) 80 days (for national important projects not using public investment funds)
b) 35 days (for group-A projects)
c) 25 days (for group-B projects)
d) 15 days (for group-C projects)
From the receipt date of valid applications, a specialized construction agency shall issue a written notice of appraisal results accompanied by stamped drawing documents.

The applicant shall submit 1 set of applications for appraisal to the construction authority.
The application for appraisal shall be submitted in person or by post.

- Process of appraisal of design following basic design
Within 05 working days from the day on which the application is received, the construction authority shall:
a) Request the applicant in writing for supplemental documents.
b) Return of appraisal application in case of rejection.
Within 20 days after receiving the above request of the construction authority, if the applicant fails to supplement the documents required, the appraising agency shall suspend the appraisal and the applicant shall re-submit an appraisal application upon further request.

- What is the time limit for appraisal of construction investment projects?
Pursuant to Article 59 of Law on Construction 2014, amended by clause 16, Article 1 of Law on Amendments to Construction Law 2020, The time limit for appraising a project shall be counted from the date the appraising agency or organization receives a complete and valid dossier, specifically as follows:
a) Within 40 days regarding class I and special class construction works;
b) Within 30 days regarding class II and class III construction works;
c) Within 20 days regarding remaining construction works.
- What are the procedures for approving the project and construction decision?
Pursuant to Article 18 of the Decree 15/2021/ND-CP dated March 3rd, 2021, of the Government:
1. The appraising agency shall have to consolidate the appraisal results and submit them to the investment decision maker for approval of the project or construction decision. The competence to decide on construction investment shall comply with Article 60 of the Law on Construction 2014, amended in Clause 17, Article 1 of the Law on Amendments to the Construction Law 2020.
2. The approval of a PPP project by the competent agency shall comply with the provisions of law on public-private partnership investment.
